Refund policy

At evolt.eu, we are committed to full compliance with the EU Consumer Rights Directive (2011/83/EU) and the Slovenian Consumer Protection Act (ZVPot-1). Please read the following policy carefully to understand your rights and obligations regarding returns, shipping costs, and refunds.


1. RIGHT OF WITHDRAWAL (14-DAY COOLING-OFF PERIOD)

If you are a consumer based in the European Union, you have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or email).

2. RETURN SHIPPING COSTS

In accordance with Article 14 of the EU Consumer Rights Directive, the consumer bears the direct cost of returning the goods.

Calculation of Return Deductions

You may choose to return the goods via a carrier of your choice at your own expense. However, if we provide a return shipping label, or if the return is the result of a refused delivery (where the carrier charges us to bring the package back), we will deduct the cost from your refund.

The deduction amount will be calculated based on the weight of the package. We will charge you EITHER the fixed rate listed below OR the actual carrier fee (GLS/DPD/FedEx/UPS), whichever is LOWER.

Example of "Lower Fee" Logic: If you return a 4kg package and the courier charges us €12.00, we will deduct only €12.00. If the courier charges us €25.00, we will cap the deduction at €20.00.


3. TIMING OF REFUNDS AND RIGHT OF RETENTION

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us).

Right of Retention (Withholding of Refund)

IMPORTANT LEGAL NOTICE: In accordance with Article 13(3) of Directive 2011/83/EU and Slovenian Law ZVPot-1, we may withhold the refund until we have received the goods back in our warehouse at Tržaška cesta 222, 1000 Ljubljana.

For refused deliveries (see Section 4 below), the refund will strictly be withheld until the package is physically received and inspected at our warehouse. We do not accept a "Refused" tracking status alone as sufficient proof of return due to potential transit risks.

Once the return is approved, we will process the refund within 14 days using the same means of payment as you used for the initial transaction.


4. REFUSED DELIVERIES AND FAILURE TO COLLECT

Refusing to accept a package from the courier or failing to pick it up from a parcel shop is not a standard return procedure. If a package is returned to us because it was refused or unclaimed, the following conditions apply:

  1. Cost Deduction: The courier charges us for the return journey. We reserve the right to deduct this cost from your refund, subject to the weight-based caps defined in Section 2.
  2. Extended Timeline: "Return to Sender" shipments are often processed as low-priority freight by carriers and can take up to 30 days to return to our facility. The refund processing time begins only after the goods have been physically received and inspected at our warehouse.

5. CANCELLATIONS OF ORDERS IN TRANSIT

We make every effort to process orders quickly. If you wish to cancel an order:

  • Before Shipment: Contact us immediately at info@evolt.eu. If the order has not been handed to the carrier, we will cancel it for a full refund.
  • After Shipment: Once an order is in the possession of the courier (DPD/GLS/FedEx,UPS), we cannot intercept it. You must either accept the package and return it, or refuse delivery. In both cases, return shipping costs will be deducted as outlined in Section 2.

6. CONDITION OF RETURNED GOODS (DIMINISHED VALUE)

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

To qualify for a full refund, items must be returned:

  • In their original condition (unused, unworn).
  • With all original tags and seals intact.
  • In the original packaging.

If an item is returned damaged, soiled, or with missing parts, we reserve the right to deduct the value lost from your refund, up to 100% of the purchase price.


7. EXCEPTIONS / NON-RETURNABLE ITEMS

The right of withdrawal does not apply to:

  • Goods made to the consumer’s specifications or clearly personalized.
  • Sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
  • Goods which are liable to deteriorate or expire rapidly.
  • Items purchased by companies/legal entities (B2B transactions) may be subject to different return conditions.

8. DAMAGED OR DEFECTIVE ITEMS

If you receive a defective, damaged, or incorrect item, please contact us immediately at info@evolt.eu with photographic evidence.

In the event of a seller error or defective product, evolt.eu covers all return shipping costs. We will arrange for a replacement, repair, or full refund in accordance with the statutory guarantee for conformity of goods.


9. DISPUTE RESOLUTION

For any questions regarding returns, please contact us at info@evolt.eu. Internal communications between evolt.eu and our logistics partners (tracking inquiries, internal tickets) are proprietary. The official tracking number provided to you serves as the primary proof of shipment status.
